Participant & Spectator Liability

Participant liability is the single most important specialty coverage in the karting business, and the one most commonly missing. A standard general liability policy frequently contains a participant legal liability exclusion: it will not pay for injuries to the people actively taking part in the activity — your drivers. So when a racer is injured in a collision, a spin, or a kart malfunction, GL can deny the claim and participant liability is what responds. Spectator liability, meanwhile, protects you when someone watching — a parent at the rail, a birthday-party guest in the pit — is struck or hurt. Because karting is inherently a speed activity with real collision energy, participant and spectator injuries are the claims most likely to turn into a lawsuit. A signed waiver helps, but waivers are challenged constantly and are often unenforceable for minors or gross negligence. Insurance is what actually pays the defense and the loss. For any track, this coverage isn't optional — it's the whole point.

Frequently asked

Isn't a signed waiver enough to protect me?

No. Waivers are a valuable first layer, but they're routinely challenged and are frequently unenforceable for minors or in cases of gross negligence. A waiver may deter a claim; participant liability insurance is what actually pays the legal defense and any judgment if a driver or their family sues.

Why doesn't my general liability already cover this?

Most GL policies written for amusement and recreation risks contain a participant legal liability exclusion. Unless participant coverage is specifically added or the policy is built to include it, injuries to your drivers can be denied — which is exactly the claim you most need covered.

Does this cover minors driving karts?

Coverage can extend to minor participants, but underwriters will look closely at your age/height policies, kart speed governors, and waiver practices. We help structure the program and risk controls so minor-driver exposure is properly covered.
